1. Acceptance of Terms

By accessing or using AutoCalcs ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. You must be at least 13 years of age to use the Service (or 16 in the European Economic Area).

2. Description of Service

AutoCalcs provides cloud-based finite element analysis (FEA) software for structural engineering calculations. The Service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts

To access certain features of the Service, you must create an account through our authentication provider (Clerk). You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account
Receiving communications from AutoCalcs, including technical notices, product updates, and marketing materials (you may opt-out of marketing communications at any time)

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or disassemble the Service
Use the Service to transmit malware or other harmful code
Share your account credentials with third parties

5. Intellectual Property

The Service and its original content, features, and functionality are owned by AutoCalcs and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any models or data you create using the Service.

6. Payment and Subscriptions

Certain features of the Service may require a paid subscription. Payment is processed through our payment provider. By subscribing, you agree to:

Pay all applicable fees for your subscription plan
Provide accurate billing information
Authorize us to charge your payment method on a recurring basis

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.

If you are a consumer in the European Economic Area, you have a statutory 14-day right of withdrawal from the date of purchase. To exercise this right, contact us at admin@autocalcs.com. For all other users, refunds are provided at our discretion.

7. Use of Platform as a Tool

You agree and acknowledge that the Service, including all its features and capabilities, is a tool intended only to assist you with structural analysis, design, and related engineering activities. The Service is not a substitute for your professional engineering judgment or independent design, analysis, and verification activities.

You acknowledge that the Service may not have been designed or tested for your specific use case, and the results produced may not achieve the outcomes you desire within your specifications, objectives, or constraints. It is your sole responsibility to:

Determine whether use of the Service is appropriate for your purposes
Verify all results, outputs, and calculations independently
Ensure compliance with all applicable laws, codes, regulations, and industry standards in your jurisdiction
Have all outputs reviewed and approved by a qualified professional engineer before use in any real-world application
Establish independent procedures for testing the reliability, safety, accuracy, and completeness of any outputs

AutoCalcs will not be responsible or liable for any issues arising from the use of the Service, including any outputs, calculations, or analysis results.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. AUTOCALCS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AutoCalcs does not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from use of the Service will be accurate, reliable, or suitable for any particular purpose; or (d) any errors in the Service will be corrected.

9. Limitation of Liability

IN NO EVENT SHALL AUTOCALCS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AutoCalcs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for breach of these Terms or conduct that we reasonably believe is harmful to the Service or other users. Upon termination, your right to use the Service will cease immediately.

If we terminate your account without cause, any prepaid subscription fees for the unused portion of your billing period will be refunded. You may request a copy of your data prior to or within 30 days of termination by contacting us at admin@autocalcs.com.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Dispute Resolution

If you have a dispute with us, please contact us at admin@autocalcs.com first and we will attempt to resolve it informally. If the dispute cannot be resolved within 30 days, either party may pursue formal proceedings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Nothing in these Terms affects your statutory rights as a consumer under the laws of your country of residence, including mandatory consumer protection laws in the European Economic Area or the United Kingdom.
